DragonPass Service Terms and Conditions

 

 

   Thanks for your attention to the DragonPass Service Terms and Conditions (hereinafter referred to as “Terms and Conditions”). This Terms and Conditions applies to your DragonPass Membership as well as the “DragonPass – Lounge Service”.

 

1 Confirmation of the acceptance of Terms and Conditions

   1.1 By clicking the button ‘I Agree’ at the bottom of Lounge Membership Application page, you will be deemed to have read, understood, agreed with and have accepted all the contents in this Terms and Conditions, and this Terms and Conditions is of immediate effect.

 

2 User Registration

   2.1 You are committed to submit your personal data for registration truly, completely and accurately, and it is your own responsibility of updating or revising the information accordingly.

   2.2 If the personal data submitted by you is incorrect, false, outdated or incomplete, the Company has the right to suspend or terminate your qualification of using the Service.

   2.3 The Company shall not be held liable for any Service delays caused by your failure on updating or correcting your personal data in time. 

 

3 Overview of “DragonPass – Lounge Service”

   3.1 “DragonPass – Lounge Service” (hereinafter referred to as “Service”) is provided by DragonPass Company Limited (hereinafter referred to as “Company”) which entitles members to enjoy special lounge services at all of its contracting lounges at airports/high-speed railway stations (hereinafter referred to as “Lounge Network”). The Service includes but not limited to comfortable seating, free refreshments, newspaper and magazines, and internet access.

   3.2 The standards of Service vary from local lounges at different airports/high-speed railway stations.

 

 4 “DragonPass – Lounge Service” Membership Account

   4.1 The Company offers two kinds of membership: Prestige Membership and Preferential Membership.

   4.2 Prestige Membership entitles members with unlimited use of the Service within One (1) year after the payment of membership annual fee.

   4.3 Preferential Membership entitles members limited use of the Service within One (1) year after the activation of membership.

   4.4 The membership card shall only be valid when it has been signed by the named member. Members are required to present the membership card or DragonPass APP with unique QR code upon enjoying the Service.

   4.5 DragonPass membership card shall not be transferred and shall not be used by anyone else other than the named member.

   4.6 Accompanying guests are allowed to use the Service along with the member:

   a)    Prestige Membership: Service Points will be deducted accordingly for the visits of the accompanying guests.

   b)    Preferential Membership: Service Points will be deducted accordingly for the visits of the member and his or her accompanying guests.

   c)    Service Points must be purchased when the remaining Service Point is not enough for the visits of the accompanying guests. 

   d)    Members must comply with the Service Regulations of DragonPass Membership. The Company shall not be held liable for any loss caused by members’ breach of Service Regulations. 5 “DragonPass – Lounge Service” Membership validity

   5.1 Members who hold Prestige Membership or Preferential Membership must activate the membership in One (1) year upon the receipt of the membership card, otherwise the membership card will be deemed as invalid.

   5.2 The membership will be valid for One (1) year after it has been activated which entitles the member to enjoy the Services at the Lounge Network. The Company will no longer provide the Service to the members whose membership is expired.

    5.3 The pre-purchase Service Points and the membership have the same valid period. When the membership is expired, the remaining Service Points could no longer be used. The validity of pre-purchase Service Points would be extended if membership is renewed upon expiration and relevant fee has been paid.

 

6 “DragonPass – Lounge Service” Service Charges

   6.1 When purchasing a “DragonPass – Lounge Service” membership, the balance of Service Points in that membership is nil, unless the members have pre-purchase the Service Points separately.

   6.2 Members of Prestige Membership could enjoy unlimited use of the Service without pre-purchasing any Service Points; for visits of the accompanying guests, it is required to pre-purchase the Service Points. The Service Charge is the same as the charges of Preferential Membership.

   6.3 Members of Preferential Membership must pre-purchase Service Points before using the Service.

   6.4 Members could continue purchasing the Service Points for lounge visits within the membership valid period. The minimum purchase shall be One (1) Service Point.

   6.5 The Service Charge of Preferential Membership are as follows

   a)   Each visit for international lounges at Beijing, Shanghai, Guangzhou, Shenzhen and all overseas lounges will be charged Two (2) Service Points.

   b)    Each visit for lounges at domestic airports will be charged One (1) Service Point.

   c)    Each visit for lounges at high-speed railway stations will be charged Half (0.5) Service Point.

   6.6 Each accompanying guests who also hold DragonPass Membership shall present membership card or DragonPass APP with unique QR code upon enjoying the Service in order to avoid any extra charges for that visit. The Company shall not be held liable for any loss of Service Points if the aforesaid accompanying guests fail to present their own membership card promptly.

   6.7 Children who are 2–year-old or elder will be charged at a full rate of their visits.

   6.8 The Company’s latest published notice in relation to the scope of Service, Service Charge, Payment Methods as well as this Terms and Conditions shall prevail.

 

7 “DragonPass – Lounge Service” Service Usage and Payment

   7.1 The standard Service for each visit is Two (2) hours. If there is any extra time required, it will be deemed, recorded and charged as a new Service.

   7.2 The Consumption List shall be provided to the members clearly setting out the date, time and numbers of the visits and requires the member’s signature for confirmation, and such signature shall be deemed as you have agreed with all the contents on the list.

   7.3 Accession to the lounges may be restricted if the lounge is already in or nearly in full capacity caused by material delays of flights or trains, and under this circumstance, the officer in charge of the lounge operation has the discretion to refuse providing the Service to other members who has not entered the lounge at that time.

   7.4 Boarding Reminder may not be available due to the limited resource at specific lounge(s), and under this circumstance, members shall take responsibility of checking the flight updates in case of missing the flights/trains. The Company shall not be held liable for any direct or indirect loss resulting from member and his or her accompanying guest’s missing of flights/trains.

 

8 Purchase and Refund

   8.1 Member should pay relevant membership fee when purchasing “DragonPass – Lounge Service” membership card. The membership is valid for 1 year. Pre-purchase Service Points becomes invalid upon membership expiration. The validity of pre-purchase Service Points would get extended when member renews his/her membership and pays relevant membership fee.

   8.2 Before member of Prestige Membership or Preferential Membership (including Guest Visit Service) uses lounge service with guests, he/she should pre-purchase Service Points for accompanying guests.

   8.3 Member can apply for refund of membership fee and unused Service Points.

   8.4 Membership fee refund: Member can contact Company’s service hotline to apply for refund within 2 months of receiving membership card and mail back membership card along with original packaging and receipt to the Company. Company will charge 10% of the membership fee for refund processing fee. If member submits refund application 2 months after receiving membership card or the original packaging/receipt is damaged or unavailable, Company will charge 20% of the membership fee for refund processing fee.

   8.5 Refund application would not be accepted if the membership card has been activated. Upon successful membership renewal, refund application for renewal membership fee would not be accepted.

   8.6 Unused Service Points refund: Member can contact Company’s service hotline to apply for refund within 2 months of the purchase of Service Points and mail back receipt. Company will charge 10% of the Service Points fee for refund processing fee. If member submits refund application 2 months after the purchase of Service Points or receipt is not available, Company will charge 20% of the Service Points fee for refund processing fee.

   8.7 Member applying for refund will be responsible for any delivery charges incurred.

   8.8 Company will process refund through the same payment method member used for the original purchase.

 

9 Amendment

   9.1 The Company has the right to amend this Terms and Conditions at any time. Any amendment will be published on the Company’s website.

   9.2 In the event members are not satisfied with the amendment to this Terms and Conditions, such member has the obligation to terminate the use of the Service. If a member continues using the Service, it shall be deemed that such member has accepted the amendment.

 

10��Notice

   10.1 All notices to members shall be published on the DragonPass official website or to be delivered via email, system message, membership account, text message or regular mails. The date of dispatch shall be deemed that the aforesaid notices have been delivered.

   10.2 Any notices from members to the Company shall be sent to the Company’s published official correspondence address, fax number, or email address.

 

11��Indemnification

   11.1 Members agree to protect the interests of the Company and other lounge visitors. If the members are in violation of applicable laws, regulations or this Terms and Conditions and in turn cause any loss of the Company or any third party, the members agree to indemnify the damaged parties.

   11.2 The Company shall be held liable for indemnification if there is any direct loss occurring due to the faults of the Company when the members are enjoying the Service.

 

12��Disclaimer

   12.1 The Company shall not be held liable nor will provide any form of guarantee to the risks of any delay in toping up the Service Points which are resulted from force majeure, computer viruses, hacking activities, system adjustment of relevant regulatory departments and telecommunication operators, and system’s instability.

   12.2 The Company shall not be held liable nor will provide any form of guarantee to the risks of being refused for getting access to the lounges when there is a force majeure, or the airports/high-speed railway stations where the lounge locates is under the state of emergency, or the lounge is full capacity.

 

13��Personal Data and Confidentiality

   13.1 You are required to designate a user name and password when registering your account, and are required to submit relevant information in accordance with the guidance. You are responsible for keeping the user name and password secure and confidential, and shall be responsible for anything happens through your account.

   13.2 The Company shall not be held liable for any loss arising out of or in connection with the computer viruses, hacking activities or your negligence on the protection of your user name and password.

   13.3 The Company will only recognize your identification via your user name and password and follow any instructions made by your account. You shall keep your user name and password properly in safe. The Company shall not be held liable for any loss due to a password leak.

   13.4 Otherwise required by applicable law or your explicit authorization, the Company will not share or disclose any of your personal data to any other parties who is not related to the Service.

 

14��Miscellaneous

   14.1 The making, performance as well as the dispute resolution of this Terms and Conditions are governed and shall be properly construed in accordance with the laws of the People’s Republic of China.

   14.2 Any dispute arising out of or in connection with the Service, you and the Company shall settle the dispute in good faith. If there is no agreement being reached by you and the Company during the friendly negotiation, you irrevocably agree to submit the aforesaid dispute exclusively to the district court where the Company is registered in.

   14.3 Any rights under this Terms and Conditions which are enjoyed by the Company but have not been performed, implemented or executed shall not be deemed as a waiver of that right by the Company.

   14.4 If any clause in this Terms and Conditions for whatever reasons becomes fully or partially illegal or unenforceable, the legality and enforceability of other clauses in this Terms and Conditions shall not be affected or impaired, and shall still be legally binding upon you and the Company.

   14.5 This English translation is for reference only. In case of discrepancy between the Chinese and English version, the Chinese version shall prevail.

   14.6 The Company reserves the right to explain this Terms and Conditions.
